Terms and Conditions

By proceeding with Emmitech Ltd’s diagnostic and repair services, you agree to the following legally binding terms and conditions, compliant with UK law: A non-refundable diagnostic fee of £25 (inclusive of VAT) is payable before any assessment of your device or system. This fee covers the inspection and identification of faults. If Emmitech Ltd successfully resolves the issue, the £25 diagnostic fee will be deducted from the total repair or service cost, meaning you will only pay for the work necessary to complete the repair beyond the diagnostic stage. In the event that Emmitech Ltd is unable to repair the issue, or if you decline the proposed repair solution, the £25 diagnostic fee remains payable and will not be refunded. This fee covers the cost of our time and expertise in identifying the fault. By agreeing to these terms, you authorise Emmitech Ltd to perform diagnostic assessments on your device or system. We will not proceed with any repairs or further services without your explicit approval after the diagnostic stage. While Emmitech Ltd takes all reasonable precautions to prevent damage, there are inherent risks in handling IT hardware and software that may lead to unforeseen damage or data loss. Emmitech Ltd will not be held responsible for any damages or data loss that occurs during service delivery, except in cases of proven gross negligence. Clients are advised to back up all data prior to service as Emmitech Ltd will not be liable for data loss under any circumstances. Clients are responsible for ensuring all important data is backed up before any service is performed. Clients must inform Emmitech Ltd of any pre-existing conditions or issues with their hardware or software prior to service. Any damage arising from issues related to pre-existing conditions, client-supplied faulty or incompatible hardware/software, or unauthorized client actions will be the sole responsibility of the client. Any perceived damage must be reported within 48 hours of service completion. Clients must provide documentation, such as photographs or diagnostic reports, to support any claims. Emmitech Ltd will review the claims but maintains the right to deny liability unless gross negligence is demonstrated. Emmitech Ltd’s liability, if any, is strictly limited to the cost of the service provided and does not cover the cost of hardware, software, or any consequential damages, such as loss of business or profits. Emmitech Ltd adheres to the Data Protection Act 2018 and GDPR. Customers are advised to back up all data prior to submitting devices for diagnostic or repair services. While we take utmost care during our work, we are not liable for any loss of data during the diagnostic or repair process. It is your responsibility to safeguard your personal information. Emmitech Ltd accepts payment via bank transfer, credit card and cash. Full payment is required upon completion of the service or as otherwise agreed prior to the service. Payments not received within 30 days will incur a late payment charge of 2% per month on the outstanding balance. Emmitech Ltd shall not be held liable for any failure to perform its obligations under these terms if such failure is caused by events beyond reasonable control, including but not limited to acts of God, war, natural disasters, pandemics, or failure of public utilities (Force Majeure). Either party may terminate this agreement by giving written notice of 14 days. Any outstanding payments for services rendered will remain due. Emmitech Ltd reserves the right to terminate services at any time without notice in the case of client misconduct, breach of these terms, or failure to comply with payment obligations. In the event of any disputes arising from these terms or services, both parties agree to attempt to resolve the issue through informal negotiations first. If the dispute cannot be resolved within 30 days, either party may seek resolution through mediation or appropriate legal channels. These terms and conditions shall be governed and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales. Failure by Emmitech Ltd to enforce any rights or provisions of these terms will not constitute a waiver of such rights or provisions. These terms and conditions do not affect your statutory rights under UK consumer protection law, including the Consumer Rights Act 2015. Should you believe any aspect of our service has not met legal requirements, you are entitled to a review and remedy in line with UK law. You may cancel our services at any time before the diagnostic is carried out. However, once diagnostics have commenced, the £25 fee is non-refundable. The Emmitech Ltd Damage Responsibility Policy will be reviewed annually to ensure it remains relevant and effective. By proceeding with our services, you confirm that you have read and agreed to these terms and conditions.
